The terms of sale detailed in this document apply to products bought via www.hutapl.com. By visiting the website and/or placing an order you accept the terms and conditions explained below. 1. The website, HUTA and you.
This website is operated by HUTA Polska Limited (trading as HUTA) whose registered office address is Flat 4, 180 Ladywell Road, London SE13 7HU, UK. The company registration number is 10734943 (England). Our contact telephone number is (+44)(0)7543 262636.
References to "we", "us" and "our" refer to HUTA. References to "you", and "your" refer to anyone who is placing an order via or using this website.
2. Contract information. The terms and conditions established herein do not affect your statutory rights.
By placing an order on our website, you are agreeing to purchase the goods selected in your order.
We reserve the right to accept your order at our discretion. If products are displayed on the site with the incorrect price, an incorrect description or are not available then we are not obliged to sell you those products.
Once your order has been placed, you will receive confirmation from us that your order has been acknowledged but this is not confirmation that your offer to purchase the goods has been accepted. A contract for the sale of our products will only exist between you and HUTA once the order has been accepted, processed and dispatched to you.
We reserve the right to change these terms of sale at any time without notifying you.
3. Conformity of products. We take every care to ensure that the description and specification of our products are correct. However, specifications and descriptions of products are only intended to give a general description of the products and are not intended to be binding. Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you.
Stripe. The HUTA website uses Stripe to process transactions using a registered email address, delivery address with postcode and credit/debit card details linked to a valid bank account containing sufficient funds. Funds must be transferred in their entirety to complete payment. Customers can pay using all major debit or credit cards (including American Express). If you have a question related to a Stripe payment, please contact us at HUTA via firstname.lastname@example.org.
5.1. We dispatch all orders via Royal Mail second-class post, unless a preferred delivery option is requested by the purchaser. After your order has been accepted, we will endeavour to dispatch your order at our earliest convenience and will inform you immediately if we are unable to dispatch your delivery within an acceptable timeframe. Orders placed before noon will usually be processed and dispatched the same day and delivered as per your request, providing further security checks are not required and all products are available. Orders placed in the afternoon and evening will normally be processed the same day and dispatched the following day.
5.2. If delivery cannot be made to your address you will be informed as soon as possible. We do not hold ourselves liable for any inconvenience suffered by you through reasonable or unavoidable delay in delivery.
5.3. When your goods are delivered, you may be asked to sign to acknowledge receipt. If the package appears to be in a poor condition then please refuse the delivery. We dispatch all deliveries in protective packaging but due to the fragile nature of our products, breakages can occasionally occur. If damage has occurred in transit, please contact us via email@example.com and we will make arrangements to replace the damaged products. Any damages to the delivery must be reported to us within 24 hours of receipt of the goods. When an item is delivered, the risk of damage to or loss of the item passes to you.
5.4. Ownership of an item does not pass to you until we have delivered the item to you (either directly, by leaving it in a safe place or with a neighbour).
6. Cancellations, returns and refunds
6.1. Your right to cancellation
You are entitled to cancel your order at any time up to 7 days after you receive the goods. To cancel your order within this time frame you must notify us in writing by email via firstname.lastname@example.org .
If you decide to cancel your order after the products have been delivered to you, you must return the goods to us at your own cost unless the products are faulty. To qualify for a full refund, the goods must be returned complete, in perfect condition, unused, unwashed and with original packaging. Providing we are happy with the condition of the returned stock, we will credit you for the products within 30 days of receipt by us.
6.2. Returns policy
If you are unhappy with your order, you are entitled to return your order at any time up to 7 days after you receive the goods. We would be more than happy to offer you an exchange or - if you wish - a refund, provided that the goods are returned complete, in perfect condition, unused, unwashed and with the original packaging. You must cover the cost of returning the goods to us unless the products are faulty.
6.3. Faulty products
If you are unfortunate enough to receive a faulty product you must inform us within 24 hours of delivery via email@example.com. The faulty products must be returned to us in line with our returns policy (6.2). When we have received the returned goods we will then verify the fault. If we agree that the product(s) are faulty we will either:
6.3.1. Replace with the same item
6.3.2. Carry out a refund in line with our refund policy
If we decide that the goods you have returned are not faulty then the order will be returned to you at your cost.
6.4. Items broken during transit
We take great care in packing our products to ensure that they stand a high chance of arriving unbroken. In the unfortunate event that a breakage occurs you must contact us within 24 hours of delivery via firstname.lastname@example.org and provide us with the following information:
o A good-quality photograph of the broken product(s), ensuring that the number of damaged products is clearly visible
o Your order reference number
o The name(s) of the product(s), and the number of products broken
o Your instruction as to whether you would prefer the replacement or refund of the
products involved. Following this, you must return the product to us within 7 days after
you received the product
6.5. When we have received the returned goods we will then verify the fault. If we agree that the product(s) are faulty we will either:
6.5.1. Replace with the same item
6.5.2. Carry out a refund in line with our refund policy
6.6. Incorrect product(s) delivered to you
If we accidentally supply you with the wrong item, please notify us within 7 days via email@example.com. The goods must be returned to us in accordance to our returns policy, detailed in Section 6.2. After we receive the returned goods, we will verify that the item is incorrect and either:
o Replace with the correct item
o Carry out a refund in line with our refund policy
6.7. Additional product(s) delivered to you. If we accidentally supply you with additional items, please notify us within 24 hours via firstname.lastname@example.org. The products must be returned to us in accordance to our returns policy, detailed in section 6.2. The goods must be returned via the same delivery method as they were provided to you. In this instance, HUTA will return the cost of the returns to you within 30 days of our receipt of the item(s). If you do not follow this procedure and are found to be in possession of goods that were sent to you unintentionally, it is possible that you will be charged for the goods.
6.8. Refund policy. If you are entitled to a refund, the funds will be returned via the same card that you used to pay for your original order. It is your responsibility to notify us of any changes to your card details i.e. the card has since expired or the account is no longer valid.
It is our aim to carry out all eligible refunds within 7 working days from receipt of the returned products. The funds may take up to 30 days to reach your bank account during the busiest times.
6.9. Returns procedure. When returning any item, except where a faulty product was delivered to you or where we have delivered the wrong item to you, you must cover the cost to return the products to us. To return any products to us, please contact us via email@example.com and clearly state whether you would prefer a refund or exchange.
Please pack the products back in the original parcel, include your name, address and order number within the package and return it to:

When you are returning items, we strongly recommended that you obtain proof of posting. HUTA cannot accept responsibility for any parcels that are lost in transit.
7.1. Changes to the contract are only binding if we agree them in writing, sign them and give you a copy
7.2. The Parties will use their best efforts to negotiate in good faith and settle any dispute that may arise out of or relate to this Agreement or any breach of it.
7.3. If any such dispute cannot be settled amicably through ordinary negotiations between the Parties, or either or both is or are unwilling to engage in this process, either Party may propose to the other in writing and the other agrees that structured negotiations be entered into with the assistance of a fully accredited mediator before resorting to litigation.
7.4. The contract is governed by English law and the courts of England and Wales will have the exclusive right to deal with any disputes arising from it.
